Is Indonesia on
the cusp of abolishing the death penalty, which is used as a sentencing tool
against terrorism, premeditated murder and drug trafficking?
Although the
death penalty is rarely handed down, it is still the focus of human rights
groups, which want the government to end capital punishment because of its
rights violation and its supposed ineffective deterrence of crime.
Two recent
developments have prompted the question.
First, it has
emerged that President Susilo Bambang Yudhoyono has been quietly using his
constitutional prerogatives to grant clemency to convicts, including those on
death row, since 2004 after winning the election.
The clemency has
reduced the sentences of 19 drug offenders, including four on death row, whose
lives have been spared from certain death by firing squad.
Three of the
condemned men were Indonesians, while the fourth was a foreigner. Their
sentences were commuted to life in prison.
Two of the
Indonesians were former civil servant Deni Setia Maharwa and his accomplice
Meirika Pranola, who were caught with a third accomplice at the Jakarta
International Airport before a flight to London in 2000. They were found to be
members of a syndicate trying to smuggle heroin and cocaine.
Deni was granted
clemency in January this year, and Meirika in November last year, on
humanitarian grounds, as they were deemed couriers, not traffickers. It was not
revealed when the third accomplice received his clemency.
Earlier last
month, a three-judge panel of the Supreme Court overturned the death sentence
of drug lord Hengky Gunawan, converting it to a prison term of 15 years.
Hengky was
convicted in 2007 of running a major ecstasy production and distribution ring
from Surabaya in East Java.
The judges said
that the death sentence in Hengky's case was antithetical to the Constitution,
which enshrines a right to life.
Second, Cabinet
members have come out not only to defend the granting of clemency to drug
offenders on death row, but also to link it to advocacy for Indonesians in
foreign prisons.
In separate
remarks, Foreign Minister Marty Natalegawa and Deputy Justice Minister Denny
Indrayana said that the decision to commute the death sentence handed down to
drug convicts was part of a wider push to move away from capital punishment.
Marty said
recently that globally, more countries had stopped using the death penalty,
although it remained on their statutes, as it does in Indonesia.
"The policy
of commuting a death sentence for a drug crime is not something that happens
just in Indonesia," he said.
"This policy
is also practiced in other countries, and Indonesians are among the
beneficiaries of such clemency."
Even as they
spoke, Malaysia announced that it was considering abolishing the death penalty
for drug offenses.
For the first
time, Denny admitted that the main reason behind this softening on capital
punishment has been the need to free Indonesian migrant workers who are on
death row overseas.
What prompted
this was the public outrage over the execution of an Indonesian maid, Ruyati
Sapubi, 54, who was beheaded for murdering her abusive employer in Saudi Arabia
in June last year.
Since then, the
Indonesian government has set up a fund to pay "blood money" to Saudi
families to seek the freedom of its citizens.
The Deputy
Justice Minister told Kompas newspaper on Oct. 23 that there were a total of
298 Indonesians on death row in other countries as of July last year.
Through its
advocacy efforts, Indonesia managed to persuade foreign governments to commute
the death sentences of 100 of them, including 44 drug offenders on death row.
"Frankly, if
our President is to make an appeal for clemency for our citizens jailed abroad,
we can strengthen our case by offering clemency to foreign convicts here,"
Denny said.
There is no
certainty that this would work as the Indonesians, including those on death row
for murder and drug trafficking, are jailed mainly in Saudi Arabia and
Malaysia. No Saudis or Malaysians are known to be on death row in Indonesia.
Indonesia may
have second thoughts on the death penalty, but it is still too early to say
that it will abolish capital punishment any time soon. It is also not certain
that Yudhoyono will grant clemency to the remaining 100 still on death row.
The majority of
Indonesians still view the death penalty for drug traffickers as justified.
While it is seen
as a rights violation by human rights lobbyists, many Indonesians also view
drug abuse as a rights violation of the victims, who cannot lead normal lives
because of their dependence on drugs fed by the traffickers.
Hence, it is not
surprising that the clemency granted by Yudhoyono to the four condemned
prisoners and the leniency given to the drug lord by the Supreme Court
unleashed a storm of criticism from public figures that underscored the
overwhelming sentiment supporting the death penalty for drug traffickers.
The Indonesian
Ulema Council (MUI), which is the highest authority on Islam, and the largest
Muslim organization Nahdlatul Ulama criticized the clemency decisions, saying
that they were a setback to the fight against drug trafficking that posed as
serious a threat to the nation as corruption and terrorism.
"The three
are extraordinary crimes and should be dealt with seriously through the
imposition of extraordinary punishments or the death penalty," said MUI
executive chairman Ma'aruf Amin.
It is clear that
according clemency to drug offenders goes against the grain of majority opinion
in Indonesia. Most people still frown upon any leniency to drug traffickers.
Hence, capital punishment will have to stay.
But the dilemma
for Indonesian leaders will be how to reconcile this domestic concern with the
task of saving the lives of many Indonesians on death row abroad for drug
trafficking and murder.

Death penalty is a delicate subject and opinions differ greatly. Some people are pros for certain reasons but other are also pros for different reasons. And it’s “easy” for those people to say “I’m pros” because they will not have to make this decision after. They will not be at the court, to decide if this person will have a death penalty or not.
ReplyDeleteHow can we take the good decision? Who can decide which reason is valid and which one is not? So I think the decision is always subjective, depending on the decider’s final opinion.
In my point of view, I think death penalty is acceptable in some case like terrorism or premeditated murder. It’s fair to punish people the same way they make wrong things. But even if it’s a valid reason according to me, it’s still delicate. Sometimes, the murderer is not aware of what he did. So maybe we don’t have to generalize the laws. I think, as death penalty is a difficult point, we have to treat the case individually. But sure, it is still a delicate decision.
I am against the death penalty. The USA showed us in a repeating way that the death penalty does not work. They have still one of the highest murder rates in developed countries and every time you kill somebody you can’t be sure if it was correct as the courts sometimes make wrong decisions. I remember several cases where people are set free after proving they are not guilty with a DNA test. They are set free then after some decades. If you kill somebody you cannot set him free anymore. On the other hand it is not working as a instrument of determent. People should better think about how to prevent the crimes that are sentenced with death than how to treat the murderers, rapists and drug dealers.

ReplyDeletemany people respond with different opinion, the one that I agreed is that dead penalty is not a good way to punish people, except that the wrongdoing is too heavy like:terrorist, something that involve making/selling illegal drugs, rapist that already rape more than once, these kind of people doesn't need penitence, nor chance to repent their sins.
Rather than giving them Death penalty, if I were the judge I would prefer to give them a lifetime prison penalty, but you can change it to death penalty by anytime
it's like Coup D`Grace, to ease their suffering, but they can repent their sins before they want to die.
As for me, it is obvious: the death penalty should be abolished all over the world! No one has the power of life or death over individuals and, by and large, over human beings even if they are terrorists. However, I believe that people who cause irrevocable and extremely serious damages while killing without mercy and voluntarily people must be condemned to a life sentence.
ReplyDeleteThis discussion about death penalty leads me to think that most countries are facing an important issue bond with their penitentiary systems. Most of the time, prisons are overcrowded, there are not enough educational programs and they do not give prisoners an opportunity to make a fresh start. One could say that from this standpoint detention does not fulfill its role of educator and that it would be useless, but this is another debate.
I am totally against death penalty. The question is why to kill people who killed people to show killing is wrong? The "eye for an eye" mentality will never solve anything. Prisoners are confined to a cage and live in an internal environment of rape and violence where they are often treated as animals. One victim's innocent family will suffer from a capital murder, but by enforcing a death sentence, you force another family to suffer.
ReplyDeleteThe court system takes long before allowing a death sentence to be carried out. Whether it's an electric chair, gas chamber, lethal injection, or hanging, it's barbaric to allow state sanctioned murder before a crowd of people.
the most important argument against death penalty is that there are several documented cases where DNA testing showed that innocent people were put to death by the government. Besides you should never forget that death penalty doesn't change the fact that the victim is gone and will never come back. So, please abolish the death penalty.
The death penalty should be prohibited at once. So many people are sentenced to death although being innocent, and only due to wrong decisions being made during their trial. The USA serves as textbook example here, several cases are already known in which death penalty was carried out and only after some years lawyers found out that the person was innocent. I would not be able to live with that information especially when I was the person sentenced the innocent one to death or helped to do so. According to my opinion there are other methods to punish people without murdering. In Indonesia death penalty is the consequence for dealing with drugs but this is ineffective, because in Bali, for instance, drugs are offered frequently. Even signs leading interested customers to dealers can be found, therefore I am asking myself "How is that possible despite death penalty?". Find other ways guys to punish people but let go of death penalty; it makes a nation a murderer.
ReplyDeleteDeath penalty should not be established in Indonesia. It will not be able to be implemented effectively in here. In my opinion, life is one of human rights which has to be respected. Nobody with any excuses is allowed to take it away from others except God. I think there are so many alternatives to punish criminals. This kind of punishment will not reduce the high rate of crime in Indonesia.
ReplyDeleteIn my opinion Indonesia cannot kill off death penalty because it can give deterrent effect to the perpetrator such as corruptor, drug dealers and killers. Those perpetrator can make Indonesia condition getting worse. If Indonesia still keep that regulation, in the future, Indonesian will think twice to behave that violate the law and hopefully it can makes Indonesia getting better and better
ReplyDeleteNowdays, death penalty does not really make senses with the reality, I disagree with death penalty rules in any cases like drugs and terrorism. Death penalty tend to prevent the drugs problem for example,in fact there are still a lot of drugs dealer in Indonesia, we can easily find a drugs dealer in touristy places like bali and Lombok.
ReplyDeleteIn Indonesia now death penalty does not really have any impact of preventing a drugs problem instead the drugs consumption still growing up. Death penalty is breaking the human right. We can not end the people life, they still have a right to change their behavior. So for me death penalty is not a correct way to punish people.we still have many option for that like the rest prison penalty.
In my opinion death penalty should be forbidden. It is just stupid in my eyes to kill someone because he killed also. That is the wrong way to punish people, because they will never learn that killing people is something wrong if even the government is doing it. How can the government take somebody's life if they do not have the power to give it back? It already happened so many times in the USA that people are declared innocent after they already received the death penalty. But that will not help them any more. Moreover, for me murderers and rapers should not just have a short death, no they have to suffer and really experience what it means to be life-long in prison. For me, that is a better method to show people they did something wrong. Furthermore I know stories in the USA that people are waiting for their death penalty already 30 years, but it is always postponed.Or sometimes the pill or the electric chair is just not working and the people have to suffer hours. We still have to respect the human rights.
ReplyDeleteCapital punishment has never been a controversial political or emotional issue in Indonesia. Although the death penalty is rarely applied, most people in the country still support its use, particularly for terrorists, serial killers, and even drug traffickers. In my opinion, death penalty is not a solution to those problems. You cannot revenge a bad action with another bad action. Furthermore, many people are innocent and are given the death sentence which is totally unfair.
ReplyDeleteI don’t completely agree with others saying that death penalty should be banned. I might have sound cruel but I’m pro death penalty. People may say that human being has no right for taking control of other human being but some people are deserve death sentence. There’s still a lot of consideration to think of if death penalty is prohibited. One tangible example of people who deserve death penalty is terrorist. He (or she) has killed a lot of innocent people with their wrong beliefs. He has been doctrine to believe such false fad that creates him to be a monster. I say it’s better sacrifice one person that lost a lot of innocent lives. Drug lords around the world should have get death sentence for their crimes. The system of drug trafficking is harder by the minute, if you can’t eliminate them one by one, our next generation could be the next victim. Indonesia is not ready to eliminate death sentence, besides people who get death sentence already gone through the process of law and consider being very dangerous.
ReplyDeleteDeath penalty should not be banned for some reason since in my opinion there are some types of crime that are too severe to be forgiven, such as terrorist. It’s such an unacceptable action for a terrorist to kill a lot of people no matter what are the reasons being used as the basis of killing lots of people. However, the other type of severe criminals such as murder and rape case should not be given the death penalty; they can just get a lifetime prisoner instead of death penalty.
ReplyDeleteI agree with Emmy’s opinion about the death penalty. For some people, death penalty may sound savage but I think the terrorists deserve it. They have killed plenty of innocent people and the government has to stop them. Killing the terrorist can prevent the distribution of terrorism doctrine. In addition, the death penalty shows that the government still has some power against terrorism. Based on these reasons, I think death penalty may be given to those who deserve it.

The death penalty should not be applied in Indonesia. Because the death penalty is a very cruel act. In other countries may impose the death penalty, as the case of the most widely experienced by Indonesian people. In addition, people could abuse the death penalty. However, if it is applied in the law in Indonesia, the government who have the power in law should use the death penalty as well as possible. And using the death penalty to punish those who deserve it, and do not show the death penalty to the community.
ReplyDeleteIn some way i can't agree with the government if the death penalty is completely banned or removed. High level and international scale criminals like internationally known drug seller, corruptors, and terrorists should be penalized with a death penalty. Those criminals are not only harming some citizen of indonesia but also Indonesia as a whole. By applying the death penalty, many will start to avoid doing crimes and will decrease criminality in numbers especially corruptors.
ReplyDeleteI also want to add that the current laws and penalties in Indonesia is still an act of injustice by people from the upper class like government and rich people. They can easily decrease or even escape penalties they're about to face by giving money to courts. Other than that, many weird cases like a sandal theft been put to jail for 5 years while corruptors only 2 years still often happen here in Indonesia.
Death penalty is the final sanction for the worst criminals. It is so ruthless to be done, since human life is actually a gift from God. When you decide a death sentence for someone, even though he is criminal, his family also would suffer from losses. But there are some criminal cases which is so severe that it couldn't be forgiven anymore, such as terrorism and corruption. I think terrorists and corruptors deserve to get death penalty since they have harm many humans' life with their actions. In addition, by applying death penalty we could decrease the rate of criminal cases effectively.
ReplyDeleteI do not think death penalty should be erased by the government; they have to keep it as it is. Maybe for some people that kind of punishment is against human right, but I think they have to consider about what the criminals, who sentenced with death penalty, have done. As far as I know death penalty (Indonesia) is given to the likes of terrorist, murderer, drugs dealers and those who did political offenses. Based on UUD 1945 (28;1) every people has the right to live and freedom; thus, I conclude that every people who offended that law should be punished with death sentenced. For drugs dealers, even they are not against that law they should be sentenced with death penalty as they are ruined life of many people.
ReplyDeleteFor some reason, although i believe that someone can't just kill each other, i agree with sasa and emmy opinion. Maybe in other country, they can do their justice properly, so they don't need to give someone death sentence after all. But, i don't think it will be worked in Indonesia. Because the law enforcers can be easily bribed right now (take example of super gayus). And of course it will bad if the prisoner is a drug lord or leader of terrorist organization. So, they need to be given death sentence. Even this sentence just give a temporary result to crime chain in indonesia, i think that is enough to law enforcers to predict their next step and preventing the same crime to happen again. At last, if the law enforcers can't really maintain the justice properly, death sentence is still needed to prevent further action from criminal. Not all people are given death sentence. Only people with serious crime which endanger many lifes which will given death sentence.
ReplyDeleteI don't think that death penalty should be banned. Although some people argue that it is too cruel, i think in some cases people deserve for it. The purpose is not to pay life with life, but it is more to encourage people to comply to law. In addition, i think death penalty might be better than some other punishment which will make people suffer for the rest of his life.
ReplyDeleteFor some reasons, I think death penalty should not be restricted. I might sound cruel, mean, and very traditional minded and very stupid. However I think it should be applied for a massive criminal who killed or considered with a lot of innocent lives. For tangible example of people who deserve death penalty is terrorist and mafia who offer many hired assassins. They have killed a lot of people for just for their own need. They do think that others life in a piece of cake so they can just throw it away when they want it. Therefore with the death penalty I hope it will has frightening effect on others who has desire to do the same think. Nonetheless death penalty should pass a legal court trial to prove the person is the right person that deserve for the penalty.
ReplyDeleteI also agree with most of the comments published on this blog. Death penalty is simply wrong. If an innocent guy or girl gets killed than we already see that this method is not working at all. Also I agree with the statement that the USA has the death penalty and is still one country with the highest murder rate in the world. Most of the time I think people who are in favor for the death penalty have a lag of education which means that they do not know better. Sometimes it really makes me angry arguing with people why the death penalty should be abolish. The reason is because the arguing on such a low level and are still convinced on what they say even if you come up with hundreds of counter arguments. So most of the times I will just listen to them without arguing because it is not worth the time you spent.
ReplyDeleteI think this country needs that kind of law especially for the corruption case. This country has suffer a lot because of those guy who stole what belongs to others. I really hate this act because we shouldn't at this level if there are no corruption. I think people should learn to avoid the corruption by giving death penalty to those do corruption. So doing corruption means death and nobody may try to do that again. Look at the history of Europe country that hanging their noble make the citizen suffer. And now we see that corruption rate in Europe at low level. So maybe we need that phase to become a great country.
ReplyDeleteRecently, the validity of the death penalty continues to be questioned. Every country has their own law which come from a view of the nation. I think, the death penalty still exists in Indonesia to fulfill a sense of justice in society, besides from the point of view of the criminal law, the death penalty was held to protect the public. If the sight and sense of justice Indonesia changed, there will come a time when the death penalty in Indonesia is eliminated.
ReplyDeleteI always being skeptical when I heard/saw/read about this, I completely don't AGREE if the death penalty removed or banned. maybe it's not banned, it's still there but maybe the authority were just too soft for it, now let's read another article about this and this is all about the government "things".

ReplyDeleteIt's an interesting article I see regarding death penalty. To me death penalty right now should be banned, not because it's wrong but our system of justice is still unstable. It's because in court there are still many case of injustice, like if you have money I can made you innocent. So to me right now for Indonesia to have the death penalty is too early.
ReplyDeleteThe death penalty should be abolished, who are we to judge that a person's life needs to be put off. Killing off a person because of his/her misdeeds is wrong, it's true that terrorists and murderers have done horrible crimes and what they did drove us mad and we're filled with rage and the death penalty seemed like a fitting punishment for them .But if we think clearly and wait until our anger subsides, won't giving the accused death penalty makes us the same as them? we're letting our anger control us and giving us the "okay" to inflict pain or cause their death. the reason they're committing their crimes might be from anger, hate or hostility towards society. I believe that sentencing them to life in prison is the best decision for punishment, i know that it's a bit lenient compared to the death penalty but that way they'll be locked for good, unable to taste the things a free man can enjoy.

I truly believe that regardless of the person, authority or any kind of institution it is, men don't have any right on others men life. Plus, giving death as a punishment and imitate those same criminals, is it not giving the sign that, eventually, killing people is ok as it is to correct "something wrong"?
